доверительный управляющий
Юридическое лицо (напр., управляющая компания) или индивидуальный предприниматель (профессиональный участник рынка), осуществляющий доверительное управление ценными бумагами или имуществом, переданными ему во владение на определенный срок и принадлежащими другому лицу, в интересах этого лица или указанных этим лицом третьих лиц. Доверительным управляющим не может быть государственная организация, в частности – унитарное предприятие, орган государственного или муниципального управления. Важно, что доверительный управляющий не может быть выгодоприобретателем (бенефициаром) переданного ему имущества, он оказывает услуги обычно за плату, исчисляемую в процентах от добытой им прибыли. То есть доверительный управляющий использует имущество не в своих интересах, а в интересах собственника или назначенного им выгодоприобретателя, причем только в пределах, установленных законом и договором.
